Any unauthorized use of this data, including the downloading of individual or collective data records, is expressly prohibited. Please contact Beta for questions relating to data integrity confidentiality and use. Neither the National Beta Club, nor its contractors nor its agents ("Beta") are responsible for the accuracy or integrity of the data maintained on the System, nor does Beta make any waranty, either expressed or implied regarding any aspect, merchantability or operation of the System.

Acceptable Use Policies
Use of the System falls under the guidelines of Beta's Acceptable Use Policies, which follow:

  1. General Comments or Information

  2. Family Content Policy
    Our Policy is to provide only the best professional content. If you find anything on the System offensive or in poor taste, please Let Us Know.

  3. Unwanted Mail Forwarding or "Spamming" Policy
    We expressly prohibit any use of the System for the unsolicitated or unauthorized forwarding of electronic mail or solicitations. This includes engaging in harassment, whether through language, frequency, or size of messages. E-City accounts or services may not be used to collect replies to messages sent from another Internet Service Provider, where those messages violate this Acceptable Use Policy or the Acceptable Use Policy of that other provider. Unsolicited commercial advertisements will likely result in account suspension or cancellation. Unsolicited commercial advertisements may be illegal according to 47 USC 227. We reserve the right to back-charge at standard rates and terms any such unauthorized use and will cooperate in the prosecution of such abuses.

  4. Acceptable Traffic
    Customers are prohibited from transmitting on or through any of Beta's services, any material that is, in our sole discretion, unlawful, obscene, unprofessional, threatening, abusive, libelous, or hateful, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law.

  5. Chain Letters
    Chain letters are prohibited on the System, by Beta and by the Internet. Posting a chain letter to newsgroups (or via e-mail on the Internet) is inappropriate. If there is money exchanged, they are illegal in the United States according to the United States Postal Service. If you receive a chain letter from a Beta user, report it to postmaster@betaclub.org immediately. If you receive a chain letter from someone on the Internet, contact the postmaster at their site (using postmaster@their.domain.name; for example, postmaster@aol.com)

  6. Miscellaneous Policies
    1. The posting of USENET articles must be consistent with the charter and conventions of the newsgroups being posted to. The posting of encoded binary files to USENET newsgroups not specifically named for that purpose is prohibited.
    2. The sending of email to mailing-lists must be consistent with the charter and conventions of the mailing-list.
    3. The posting of a USENET article to a large number of irrelevant newsgroups (commonly referred to as spamming) is prohibited.
    4. Willfully causing or attempting to cause disruptions of E-City's services is prohibited, and E-City will actively seek prosecution of, and legal remedy from, such acts.
    5. Use of an excessive amount of any system resource such that other users are unfairly affected, is considered abusive, and is prohibited.
    6. Unauthorized use of accounts belonging to others is prohibited.
    7. Unauthorized use of Administration capabilities reserved for Beta Sponsors and/or the National Office of the Beta Club is prohibited.
    8. Reasonable precautions to prevent unauthorized access to your account, such as through the use of passwords and file protections, must be taken. Beta is not responsible for alterations, additions and deletions made to your account It is your responsiblity to verify on a periodic basis the accuracy and efficacy of your information contained in the System.
    9. The resale of our products and services and technologies is not permitted, unless specifically permitted and documented in a written agreement.
    10. Misrepresenting your identity or impersonating others is prohibited, including, but not limited to, forging email or USENET
      posting header information.

  7. Cancellation of Service
    Beta reserves the right to immediately terminate the services offered to any user of the System for any activity considered detrimental by Beta to the operation of any aspect of the System.

  8. Disclaimer
    Beta is providing this site and it's content on an "AS IS" basis and makes NO representations or warranties of any kind with respect to this site or its contents. Beta disclaims all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, Beta does not represent or warrant that the information accessible via this site is accurate, complete or current. Any pricing or availability information is subject to change without notice.
    Except as specifically stated on this site, neither Beta nor any of its managers, directors, employees, contractors, agents or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

  9. Trademarks
    All trademarks, product names and company names or logos cited or used on the System are the property of their respective owners.

  11. Submitting Complaints
    To report a violation of E-City's Acceptable Use Policy, send a complete copy of the offensive or illegal article or e-mail message to postmaster@betaclub.org. You may also want to contact the National Fraud Information Center or the Federal Trade Commission (FTC) Bureau of Consumer Protection at dmedine@ftc.gov, if appropriate.
